Need Legal HOA Advice

I live in a first floor condo with a Unit above me. The owner of the Unit above me recently renovated and installed some kind of tile and wood flooring on the first floor without HOA approval and against the rules of sound barrier installation being required. The HOA contacted the owner who said he was selling the Unit and a disclosure would be added stating the new buyer would have to install a sound barrier before escrow closes. Now the Unit owner has rented the unit instead of selling the unit…with out any sound barrier. I live below this what can I do? As it lowers my property value…and disturbs my peace. Located in California
